It has been postponed for Wednesday, so that the investigator can confirm whether it is true or false that two of the three suspects are out on parole in the case involving the driver of a toll car and his passengers.
The suspects, Mr. Njabulo Ndimande, Mr. Bongani Mazibuko and Mr. Mduduzi Mnyaka appeared at the Pinetown Magistrate’s Court on Friday, hoping to apply for bail.
The suspects, who appear to be security guards at the On Call Security company, were arrested on June 4, 2026, following the spread of a video showing them attacking the driver of a toll car and his passengers. This incident which spread on social media with a video that recorded what happened, is said to have happened in Kwa Ndengezi, on June 3.
They are facing three charges, one of which is attempted murder, vandalism and assault.
When they appeared in court on Friday, the prosecutor, Mr. Sfiso Mtshali, told the court that the State will oppose the bail request if the accused have submitted it, however, he pointed out that it is difficult to proceed as the detective’s investigation is still lacking.
During the investigation, he revealed that there is still a shortage, he said that since the suspects were arrested with three guns, it has not been confirmed which gun is among the suspects.
“The investigation of whether the firearms are legal by obtaining information about their licenses is also not yet available. There is information that they are in possession but the investigator has not yet confirmed that with the owner of the company,” said Mtshali.
He also pointed out that there is still a lack of statements from three passengers who were with the driver of the paid car for the distance traveled when the incident happened. In addition, he said that the detectives have not yet confirmed the addresses of the suspects who may go out and live in case they are released on bail.
Mtshali and magistrate Mrs. Wendoyln Robinson expressed surprise that this was agreed upon for the investigator to do about a week ago following the postponement of the case since it first appeared on June 5.
Mtshali went on to state that the State will oppose their release on bail as the driver of the car who is paid for the distance traveled who filed the case, revealed that he received threats after filing the case from people who ordered him to drop the case if he did not want to get into trouble.
“He is still receiving these threats, that’s why he didn’t even come to court today (he said on Friday). He revealed that before he was attacked recently, in April this year, he was threatened by the suspects, telling him to stop loading passengers,” said Mtshali, who revealed that even the owner of the security company is involved in making threats.
Mrs. Robinson has said to stop the case for a while, demanding that an investigator be found to explain why she did not do the investigation she was supposed to do after the case was adjourned on June 5?
However, when the case came back, Mtshali revealed that the investigator said he was in Pietermaritzburg on business, and sent another colleague to bring some of the statements that were said to be missing.
“Although there are some of the statements that were missing, we are getting more information that the two suspects committed the incident while they were out on parole for other crimes they were arrested for,” said Mtshali.
The accused’s private lawyer, Mr. Mcebo Buthelezi, got up to talk to them, and came back telling the court that they had never been arrested before.
“They said that they were questioned by the person in charge of parole prisoners in Westville prison, who confirmed that they have never been released on parole,” said Buthelezi, who told the court that at the moment, he does not have any information on who the accused person is who confirmed this.
Mtshali emphasized the suggestions that the State opposes that they should be released on bail, he said that there is a high probability that the threats will continue if the suspects are out of the country.
Mrs. Robinson concluded by saying: “The case is adjourned to June 17, 2026, in order to confirm the information about the parole as well as to conduct further investigation of the bail application.
Entering the court, the suspects appeared to be at ease, the first one was seen smiling at his relatives, whom he saw sitting on the benches during the trial.
There were many relatives who attended the case, and when the magistrate decided to adjourn the case to Wednesday, they showed their displeasure by saying they were proud, while others voiced their displeasure. They were reprimanded by the police officer of the court for this behavior, and the magistrate even warned them that if they behave in this way, they will not be allowed to enter the court in the future.
The Minister of Transport, Mr. Siboniso Duma, praised the driver of the paid car for the distance traveled with the women he was riding for being brave despite being threatened.
He also called for action to be taken against the owner of the security company for allegedly threatening the driver of the toll car.
