The Human Rights Commission (SAHRC) has welcomed the gender court’s decision that found Ngizwe Mchunu, guilty of hate speech, harassment and unfair discrimination against LGBTQIA+ people. The Commission, along with TransHope and the Hate Crimes Working Group represented by Human Rights lawyers, confirmed the result that Mchunu’s behavior and publication violated South African equality law. SAHRC said it initially tried to resolve the matter out of court, but those efforts failed.

This court then issues strict instructions that Ngizwe must follow, firstly that he can no longer publish on any internet platform that discriminates directly or indirectly against any LGBQTIA+ people or communities.

2. Knowing that his march to Mai Mai on 5 October 2025 included homophobic abuse.

3. He is not allowed to incite any people to threaten LGBTQIA+ people

4. He is ordered to publish an apology in 5 days from today on his Facebook page and stay on this forum for three months.

5. He is ordered to pay R250k to an organization selected by the Human Rights Commission.

6. Khe must receive the assistance of “20 hours of human rights awareness training under the Commission or an authorized institution.”

7. He must pay South African Human Rights lawyers.
