The National Prosecuting Authority (NPA) has decided not to file the case regarding an alleged road rage incident in Emmarentia at this stage, pending further investigation.
The incident took place on 19 April 2026.
Magaboke Mohlatlole, spokesperson for the NPA in Johannesburg, says the decision follows a thorough consideration of the available evidence.
“Further investigations are necessary to ensure that all relevant facts are properly investigated and established before a decision is made to prosecute.”
Meanwhile, the case remains under active investigation, with orders that additional evidence must be collected to strengthen the case.
“Once the investigation is completed, a decision will be made as to whether prosecution will be instituted. The NPA remains committed to upholding the rule of law and ensuring that all prosecution decisions are based on sufficient, credible and admissible evidence, in the interests of justice.”

Maroela Media earlier reported that a 58-year-old man appeared in the magistrate’s court in Johannesburg after the alleged road rage incident during which a man was shot dead in front of his two children and his wife and another person were wounded. This followed after a car apparently rammed into another from behind.
The incident took place in the vicinity of Barry Hertzog Drive in Emmarentia. In footage of the incident, five shots are heard shortly after each other. It also shows the victim’s young daughter crying hysterically at the scene after the shots.
Col. Dimakatso Nevhuhulwi, police spokesperson, said at that stage that the collision led to a physical altercation. “The female passenger, presumably the wife of one of the drivers, allegedly retrieved a firearm from the car. The other driver then also produced his firearm. This led to the shooting in which the husband (of the woman) died. The other driver suffered minor injuries and the female passenger was brought to the hospital with a gunshot wound.”
