The Speaker of the National Assembly, Ms Thoko Didiza, has decided the plan to be followed by the National Assembly in response to the decision issued by the Constitutional Court on Friday, 8 May 2026, in the matter concerning the Economic Freedom Fighters who accused the Speaker of the Parliament and others, regarding Rule 129I of the Laws of the National Assembly and the report of the independent judicial panel led by the former president of the judiciary Sandile Ngcobo.

According to the statement issued by the Parliament, we stated that Didiza respects the decision of the Constitutional Court and will fully comply with the order and directives of the Court.

The following list of steps has been outlined:

1. In line with the revised reading of Rule 129I, the Speaker will formally inform the National Assembly of the independent panel’s report by presenting the appropriate journals to Parliament.

2. The Speaker will provide the president with a copy of the report of the independent team as soon as possible, as ordered by the Constitutional Court.

3. In line with the court’s decision, the Speaker will begin the process of organizing a committee to investigate the case according to Rules 129J to 129O of the Rules of the National Assembly to consider the investigative process of section 89 proposed in the Constitution and the Rules of the Assembly.

4. The Speaker will officially forward the report of the independent team to the Committee that will investigate the case as ordered by the Constitutional Court.

5. The Speaker will refer the decision of the Constitutional Court to the sub-committee of the National Parliament for the review of laws to consider the necessary amendments to the Laws of the National Assembly following the findings, readings, and directives of the Court. The subcommittee will report on its work to the rules committee, which will submit its recommendations to the National Assembly for consideration.

6. The Speaker will determine the appropriate plan, procedural plans, deadlines and institutional support measures necessary for the investigative committee to be able to carry out and complete its work effectively, impartially and within the framework of the Constitution and the Laws of the National Assembly.
