The lack of clarity on whose hands the docket is in, has led to the case of the brutal murder of a man from Koffee Farm, KwaNdengezi being postponed to next Wednesday.
Mr. Kholwani Cele (34) is said to have been beaten to death, his body was covered with a stone, and then thrown into the Mngeni river. He was last seen alive on October 23, last year, leaving work, going home.
In January this year, a neighbor, Mr. Sibongiseni Johannes Mbhele, was first arrested, and later those who were accused of being accomplices in committing the crime, Mr. Bongumusa Mkhonto and Mr. Sboniso Phungula, who are also from the area.
Yesterday, the State made a request for the case to be adjourned for further investigation. Among them, it is revealed that the docket of the case is not in front of the court and it is not fully understood which office it is in.
It turned out that when the case was adjourned earlier, there was no docket either, it turned out that it was with a psychiatrist. It was said that he was expected to write a report and add it to the docket after examining Mbhele’s state of mind.
Earlier, an order had been issued for him to undergo a psychiatric evaluation following the emergence of information that he had suffered from mental disorders many years ago.

The magistrate, Mrs. Wendolyn Robinson, adjourned the case to next Wednesday.
The suspects attended the trial via video from Westville Prison, and did not appear in person at the Pinetown Magistrate’s Court.
Although the family of the deceased expressed surprise at the mystery of where the dock is, they said that they have not yet filed any complaints about the case, and will continue to come to the court to appear.
The deceased, as he had gone missing while returning from work in October last year, had been considered a missing person for three months. The police investigation finally revealed that his neighbor, Mbhele, was responsible for his disappearance. After his funeral, the family and the police went to the scene of the incident where they found the body of the deceased, and buried it with dignity.
He expressed his shock that Mbhele was the first suspect in the case, saying that they were very familiar with the deceased, who always came to their home to visit him.
However, they pointed out that after his disappearance, there was a time when Mbhele was also said to have disappeared, which was something that surprised them whether he was being misled but there were those who suspected that he was running away from being “involved” in the death of the deceased.
Allegations that the deceased had something to do with Mbhele’s wife were dismissed by the family, saying that he was a self-respecting person, who would not be ashamed to have sex with someone’s wife. They say they hope that when the case continues, Mbhele will reveal the real reason why he killed the deceased.
