PRESIDENT Cyril Ramaphosa has revealed that he accepts and respects the decision of the Constitutional Court which decided that Parliament did not properly handle the Phala Phala issue.
Spoken by his spokesperson, Mr. Vincent Magwenya, Ramaphosa said that no one is above the law, and that the allegations against him must be followed up according to the law, impartially and not dependent on a particular side.
“The President has seen the decision taken by the Constitutional Court in this case which was previously appealed by the Economic Freedom Fighters, using Section 89 of the law. Therefore, the President respects the decision and undertakes to follow all the provisions of the law of the land,” said Magwenya.
Continuing, he said that Ramaphosa is committed to provide any assistance that may be required from him so that this issue can be handled in a proper manner and to the satisfaction of those involved.
“Ramaphosa is adamant that no one is above the law, and that all allegations against him must be investigated impartially,” he said.
Yesterday the Constitutional Court ruled that Parliament broke the law when it voted in 2022, objecting to Section 89 of the law – which was the basis for the alleged violation of the law against Ramaphosa – which resulted in the discovery of large sums of money on his farm in Phala Phala, Limpopo, in 2020.
The Court found that the decision of the Parliament was inappropriate, and not in accordance with the law at all, and decided that the report of that time should be withdrawn, and the opportunity will be opened for the issue to be followed up and re-investigated.
This case was referred to the Court by the EFF and the African Transformation Movement, complaining that the Parliamentary Committee decided on this issue before the right time.
So this decision of the Constitutional Court means that now it will be necessary for the Parliamentary Committee to reconsider and decide how the solution will be reached.
The leader of the EFF, Mr. Julius Malema, said that they accept the decision and said that they hope that it will help justice be done and the scandal surrounding the President’s case will be brought to light.
“People should know what is happening in Phala Phala so that they can decide for themselves with complete information whether they vote for a criminal in the next election or not,” said Malema.
ActionSA National Chairman, Mr. Dewan de Swardt, also likened this decision to a symbol of victory for the people of South Africa.
“This is a very good coincidence as it will mean that when this issue is discussed again in Parliament, it will no longer be the ANC that has seized power alone, which would make it easier for it to protect its leader,” said de Swardt.
