A Kariega woman who claims she shot and killed her husband in self-defence will find out this week if her application to declare additional evidence inadmissible has been successful.

Natasha van Eck is accused of killing her husband, Gideon van Eck, during an argument on their Bakenkop farm in Kariega, Nelson Mandela Bay, in November 2022.

She was arrested on 13 November 2022, shortly after the incident.

The case was not initially enrolled at the time – but due to insufficient evidence against the accused, she was later released from custody on a warning.

After obtaining more witness statements, the matter was placed back on the court roll for the start of trial in October 2023.

Van Eck was due to reappear in court on Monday, but the matter was postponed in her absence.

Her lawyer, George Malgas, previously applied in this court to have evidence declared inadmissible that the State wants to place on record.

The evidence relates to WhatsApp messages the deceased sent to his sister months before he was killed.

In his application, Malgas said the evidence would be based on hearsay, especially since the deceased was not there to defend himself.

The court will deliver judgment on this interlocutory application on Wednesday.

News24 previously reported that family members said the Van Eck couple had a long history of arguments.

However, Van Eck told police that she had acted in self-defence.
